"جَرَائِمُ اِسْتِغْلَالِ القُصَّرِ دِرَاسَةٌ مُقَارِنَةٌ بَيْنَ الشَّرِيعَةِ الإِسْلَامِيَّةِ والتَّشرِيع الجَزَائِرِيِّ -التَّسَوُّلُ وَالاِعْتِدَاءُ الجِنْسِيُّ أُنْمُوذَجًا-

Résumé: "إِنَّ مِنْ أَسْمَى حُقُوقِ الطِّفْلِ القَاصِرِ أَنْ تُحْفَظَ لَهُ حُقُوقَهُ، وَذَلِكَ مِنْ أَجْلِ أَنْ يَنْعَمَ فِي الحَيَاةِ وَأَنْ يُصَانَ مِنْ أَيِّ اِعْتِدَاءٍ أَوْ اِسْتِغْلَالٍ. وَالطِّفلُ القَاصِرُ هُوَ مَن لمْ يَبلُغ سِنَّ الرُشدِ، وَبِسَببِ ضُعفِهِ وَقِلَّةِ الوَعيِ وَالإدرَاكِ عِندَهُ يَتعرَّضُ لِلكَثيرِ مِنَ الاسْتغلَالَاتِ وَالاعتِداءَاتِ المتَكَرِّرَةِ؛ حَيثُ يُسْتَغَلُّ فِي التَّسَوُّلِ َأوَ فِي الاِعْتِدَاءِ الجِنْسِيِّ أَو فِي غَيرِهَا مِن أَنوَاعِ الاستِغلَالَاتِ الكثِيرَةِ الأُخرَى، وَكُلُّ هَذَا يَعُودُ عَلَى الطِّفْلِ القَاصِرِ بِالأَثَرِ السِّلبِيِّ نَفسِيًّا وَبَدنِيًّا مِنْ اِكْتِئَابٍ وَعُزْلَةٍ وَتَدَنِّي تَحْصِيلِهِ التَّعْلِيمِيِّ وَغَيْرِهَا مِنَ الآثَارِ السِّلْبِيَّةِ الأُخْرَى. لِذَا حرصت الشَّرِيعَةُ الإِسْلَامِيَّةُ وَكَذَا المُشَرِّعُ الجَزَائِرِيُّ بِوَضْعِ عُقُوبَاتٍ وَآلِيَّاتٍ عِلَاجِيَّةٍ عَلَى كُلِّ مَنْ يَرْتَكِبُ هَذِهِ الجَرَائِمِ ضِدَّ القُصَّرِ، وَوَضَعُوا آلِيَّاتِ حِمَايَةٍ لِلْحَدِّ مِنْ هَذِهِ الجَرَائِمِ "One Of the supreme rights of minor child is to preserve his rights in order to be biessed in life and to be protected from any abuse.
