الانتقال من المجلس الدستوري إلى المحكمة الدستورية في الجزائر "تغيير في الشكل أم في الجوهر" The Transition From The Constitutional Council To The Constitutionel Court In Algeria "a Change In The From Or In The Core"

Résumé: أسس التعديل الدستوري01 نوفمبر 2020 لمحكمة دستورية وتخلى على نظام المجلس الدستوري الذي كان سائدا في دساتير 1963 ــــــــــــــ 1989 ـــــــــــــــ 1996 والتعديل الدستور ي06 مارس 2016. بين وحدد التعديل الدستوري 2020 تشكيلة المحكمة الدستورية واختصاصاتها ومناهج عملها وبدى من النصوص أن المحكمة الدستورية تختلف عن المجلس الدستوري تأصيلا وتأسيسا، ومن حيث أدوات ومناهج عملها فهل وفر المؤسس الدستوري للمحكمة الدستورية آليات ومرتكزات تسمح لها بترقية الحياة الديمقراطية وضبط النزاعات بين السلطات الدستورية وحماية فعالة لحقوق وحريات المواطن؟ The constitutional amendment established on November 01st , 2020, a constitutional court and abandoned the Constitutional Council system that prevailed in the constitutions of 1963-1989-1996 and the constitutional amendment on March 6th , 2016. The Constitutional Amendment 2020 established the composition of the Constitutional Court, its jurisdiction and methods of work, and it appears from the texts that the Constitutional Court differs from the Constitutional Council in its foundations , and in terms of its methods of work, so did the constitutional founder provide the constitutional court with mechanisms and foundations that allow it to promote democratic life and control disputes between constitutional authorities and effective protection of the rights and freedoms of the citizen?
