الآليات القانونية الدولية لمكافحة الإساءة للمقدسات الدينية The International Legal Mechanisms To Combat Insulting Religious Sanctities

Résumé: للمقدسات الدينية أهميّة بالغة لدى الأفراد والمجتمعات والأمم، ويشكّل الاعتداء عليها خطرا كبيرا على الأمن والسّلم العالميين، وقد جاءت هذه المداخلة لتبيّن الآليات القانونية الدولية التي تعزّز المركز القانوني لهذه المقدّسات على مستوى القانون الدولي، وتبرز مختلف الإجراءات الجنائية التي يمكن من خلالها ملاحقة المسيئين للمعتقدات والرموز الدينية ومقاضاتهم وطنيا ودوليا، كما برهنت هذه الدراسة على ضرورة تكييف جرائم ازدراء الأديان ضمن الجرائم الدولية، والسعي إلى استصدار قانون دولي يجرّم الإساءة للمقدسات الدينية، ويرصد العقوبات المناسبة لها، بما يحفظ الشعور النفسي للمؤمنين بها، ويجنّب العالم ويلات الأزمات والحروب التي تنشب جرّاء مثل هذه الجرائم العقدية. Religious sanctities are of great importance to individuals, societies and nations, and their attack poses a great threat to global peace and security. This intervention came to show the international legal mechanisms that enhance the legal status of these sanctities at the level of international law, and highlights the various criminal procedures through which abusers of beliefs and symbols can be prosecuted. This study also demonstrated the need to adapt crimes of defamation of religions within international crimes, and to seek to issue an international law that criminalizes insulting religious sanctities, and monitors the appropriate penalties for it, in a manner that preserves the psychological feeling of its believers, and spares the world the scourge of crises and wars that erupt as a result of such nodal crimes
