حدود الحصانة البرلمانية في ظل التعديل الدستوري لسنة 2020

Résumé: تتناول هذه الدراسة موضوع حدود الحصانة البرلمانية في ظل التعديل الدستوري لسنة 2020 باعتبارها ضمانة أساسية لعضو البرلمان للقيام بمهامه النيابية وحمايته من شتى أنواع الضغوطات والتهديدات التي قد تؤثر على استقلاليته، لذلك أقر المؤسس الدستوري منع اتخاذ أي إجراء جزائي ضد عضو البرلمان إلا بعد تنازل صريح من المعني عن حصانته أو بقرار من المحكمة الدستورية صاحبة الإختصاص بالفصل في حالات رفع الحصانة البرلمانية بعد إخطارها من قبل الجهات المختصة، لاسيّما بعد التجربة التي عرفتها الجزائر من خلال العديد من حالات الفساد المرتكبة من طرف أعضاء البرلمان والذين استخدموا الحصانة البرلمانية لتغطية تجاوزاتهم والحد من سلطة القضاء في تحريك الدعوى العمومية. This study deals with the topicof the limits of parliamentary immunity in light of the constitutional amendment of 2020 as a basic guarantee for a member of Parliament to carry out his parliamentary duties and protect him from various types of pressures and threats that may affect his independence. concerned his immunity or by a decision of the Constitutional Court with jurisdiction to adjudicate in cases of lifting parliamentary immunity after being notified by the competent authorities, especially after the experience that Algeria has known through many cases of corruption committed by members of Parliament who used parliamentary immunity to cover their transgressions and limit the authority of the judiciary in filing a public lawsuit.
