الآليات التنظيمية لممارسة الحق النقابي في التشريع الجزائريregulatory Mechanisms For Exercising Trade Union Rights In Algerian Legislation

Résumé: يُعد الحق النّقابي أهم حق تُحقّقه المجتمعات الحديثة، إذ أصبح شرطاً لازماً لفاعلية تشريع العمل، ولأهمية هذا الحق أقرّه كلّ من المشرع الدّولي والوطني، ويعتبر هذا الإقرار أهم الضّمانات التي تخوّل للعمّال وأصحاب العمل تأسيس منظمات نقابيّة دون أي إذن مسبق من السّلطات المختصّة من أجل الدفاع عن المصالح المادية والمعنوية للعمّال، ولتمثيل أفضل للعمّال عن طريق التّعرف على مصالحهم وضع المشرع آليات تنظيمية لممارسة هذا الحق، والتي أوردها ضمن القانون 90-14 المتعلّق بكيفيات ممارسة الحق النقّابي. The trade union activity is the most important right achieved by modern societies, as it has become a necessary condition for effective labor legislation Because of the importance of this right it has been approved by both the national and international authorities. This approval is considered one of the most important guarantees that allow workers and to better represent workers by identifying their interests, and the legislator has put in place organizational mechanisms to exercise this right, and It was included in Law 90-14 on the modalities for the free exercise of trade union rights.
