حماية ممارسة الحق النقابي في الجزائر Protection Of The Exercise Of Trade Union Rights In Algeria

Résumé: لطالما أولت الجزائر اهتماما بالغا بالتطورات والتغيرات الحاصلة في المجتمع الدولي، ولذلك فإنه في المجال القانوني نجدها تنضم وتوقع على جل الاتفاقات الدولية التي ترمي إلى تعزيز الحرية والمساواة، وفي مجال الحق النقابي نجدها انضمت إلى العديد من هذه الاتفاقات والمعاهدات، ولقد أشارت إليها في القانون الجديد المتعلق بممارسة الحق النقابي رقم 23/02، الذي أولى اهتماما خاصا بالحرية الفردية والجماعية على حد السواء، وكذا بكل ما يخص تأسيس الفدراليات والكنفدراليات كشكل من أشكال التجمع النقابي. إن هذا المقال ما هو إلا غيض من فيض في الدراسة التي أولت اهتماما واسعا بموضوع الحق النقابي، في الجزائر نسعى من خلالها إلى تبيان أهم النقاط حول حماية الحق النقابي، وحماية أعضاء النقابة. Algeria has always paid great attention to the developments and changes taking place in the international community. Therefore, in the legal field, we find it joining and signing most international agreements aimed at promoting freedom and equality. In the area of trade union rights, it has joined many of these agreements and treaties, which are also referenced in the new law related to the exercise of trade union rights, Law No. 23/02. This law places special emphasis on both individual and collective freedom, as well as on the establishment of federations and confederations as forms of trade union gatherings. This article is just a glimpse of a broader study that has paid significant attention to the issue of trade union rights in Algeria. It seeks to highlight the key points concerning the protection of trade union rights and the protection of union members.
