السلطة التشريعية لرئيس الجمهورية في تقييد الحقوق والحريات خلال الأزمات الصحية ( حالة كورونا نموذجا )

Résumé: يتمتع كل إنسان بمجموعة من الحقوق والحريات التي لا يمكن التنازل عنها، لكن حين حدوث خطر يهدد البلاد تتوسع الصلاحيات الممنوحة للسلطة التنفيذية للتشريع عن طريق الأوامر وتضيق بالمقابل الحقوق والحريات الممنوحة للأفراد، لذلك عندما يشرّع رئيس الجمهورية يجب أن يتقيد بجملة من الشروط الواردة بالنص الدستوري ( المادة 142 من دستور 2020)، كما يجب عليه أن لا يتجاوز النطاق المحدد إلى حد يمس بجوهر الحقوق والحريات. لقد فرضت الأزمة الصحية التي تعيشها الجزائر بسبب انتشار فيروس كورونا إلى تقييد مجموعة من الحقوق والحريات، مما دفع رئيس الجمهورية إلى إصدار مجموعة من الأوامر التشريعية حفاظا على النظام العام والصحة العامة. Every person enjoys a set of rights and freedoms that can’t be waivered, however while a danger that threatens the country is occurring, the aptitudes granted to the Legislative Authority are broadened to enact through orders and, consequently, restrain the rights and freedoms granted to individuals. Therefore, when the President of the Republic initiates, he shall refer to a whole set of conditions existing in the constitutional text (Article 142 (of the Constitution 2020). He also shall not overstep the determined framework to a limit that can alter the essence of rights and freedoms. The health crisis that Algeria undergoes because of the spreading of Corona Virus, has imposed the limitation of a number of rights and freedoms, that shoved the President of the Republic to issue a set of legislative orders , to preserve the public order and the public health.
