منازعات الترشح للانتخابات البرلمانية في ظل القانون العضوي 16- 10 المتعلق بالانتخابات.

Résumé: يعد الترشح للانتخابات البرلمانية من أهم الحقوق السياسية على أساس أنه يمثل أحد أهم صور المشاركة السياسية ،وحماية لهذا الحق سعى المشرع الجزائري على إحاطته بجملة من الضوابط و الإجراءات القانونية. كما منح حق الطعن القضائي كآلية ضامنة لحق المترشح في النظر في قرارات الإدارة أمام جهة قضائية تتوفر على مقومات الحياد والاستقلالية. وبالرغم من ذلك سجلت العديد من التجاوزات و الخروقات التي اعترضت مسار الانتخابات البرلمانية في أهم مراحلها التحضيرية ألا و هي عملية الترشح. الكلمات المفتاحية : منازعة ؛ الترشح ؛ الانتخابات البرلمانية ؛ الطعن القضائي Abstract: Candidacy for the parliamentary elections is one of the most important political rights on the basis that it represents one of the most important forms of political participation. In order to protect this right, the Algerian legislator sought to provide him with a number of legal controls and procedures. The right of judicial appeal was also granted as a mechanism guaranteeing the right of the candidate to consider the decisions of the administration before a judicial body that has the elements of impartiality and independence. In spite of this, many of the violations and violations that obstructed the course of the parliamentary elections were recorded in the most important stages of the preparatory process, namely the candidacy process.
