الضوابط الوقائية في مجال مكافحة الفساد Preventive Controls In The Field Of Combating Corruption

Résumé: إن الهدف من هذه الدراسة يكمن في الوقوف على مدى اهتمام الدولة الجزائرية بتحديث منظومتها الجزائية سواء من حيث التجريم و العقاب بما يتماشى مع التزاماتها الدولية بدءا بالمصادقة بتحفظ على اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الحدود الوطنية ثم مباشرة تجسيد ذلك بإصدارات متتالية لترسانة من القوانين الجنائية من بينها تجريم تبييض الأموال بمقتضى القانون 05-01 المؤرخ في 06 فبراير 2005 ، ثم القانون 06-01 و المؤرخ في 20 فيفري 2006 المتعلق بالوقاية من الفساد و مكافحته، ثم تجريم المساس بأنظمة المعالجة الآلية للمعطيات بموجب القانون رقم09-04 المؤرخ في 05 أوت 2009 المتضمن القواعد الخاصة للوقاية من الجرائم المتصلة بتكنولوجية الإعلام و الاتصال و مكافحتها وأخيرا القانون 22- 08 المحدد لتنظيم السلطة العليا للشفافية و الوقاية من الفساد و مكافحته . The aim of this study is to determine the extent of the Algerian state's interest in modernizing its penal system, both in terms of criminalization and punishment in line with its international obligations, starting with the reservation ratification of the United Nations Convention against Transnational Organized Crime, and then directly embodying that with successive issuances of an arsenal of criminal laws. Among them is the criminalization of money laundering under Law No. 05-01, then Law No. 06-01 related to the prevention and control of corruption, then the criminalization of infringement of automatic data processing systems under Law No. 09-04, which includes special rules for preventing and combating crimes related to information and communication technology, and finally the law 22-08 specified for the organization of the supreme authority for transparency and the prevention and combating of corruption.
