التعويض عن العجز الدائم الناتج عن حوادث العمل في القانون الجزائري

Résumé: ملخص: يهدف هذا البحث إلى توضيح كيفية حساب التعويض عن العجز الدائم الناتج عن حوادث العمل باعتباره تعويضاً جزافياً محدداً قانوناً بشكل مسبق، مع شرحٍ للعناصر التي يتطلب القانون الساري المفعول توفرها كمعطيات قبل البدء في حساب مبلغ الريع أو الرأسمال التمثيلي لأي ضحية على أن تتكفل هيئة الضمان الاجتماعي بدفع هذه المستحقات. وبغض النظر عن ما يقال بخصوص الأساس القانوني لتحديد نسب هذا العجز تزداد هذه العناصر تداخلا فيما بينهما عند تعدد العاهات وتعاقبها مما يُعقّد عملية حسابه، اذ يظهر عملياً أن النصوص القانونية المحددة لهذا التعويض الجزافي غير كافية لتحقيق العدالة للضحية المصاب بهذا العجز مقارنة بنفس العجز في نظم تعويضية أخرى، مما يستوجب تعديل بعض العناصر واضافة عناصر أخرى. كلمات مفتاحية: التعويض، العجز الدائم، حادث عمل، ريع، رأسمال تمثيلي. Abstract: This paper aims to clarify how the indemnity for permanent incapacity resulting from work accidents is calculated as a per-determined juridical indemnity, with an explanation of the elements required by the applicable law as data before starting to calculate the amount of rent or representative capital of any victim provided that the Social Security Authority to pay these dues. Regardless of what is said regarding the legal basis for determining the proportions of this disability, these elements become more intertwined when multiple disabilities are punished and complicate the calculation process. Other compensatory elements, which necessitates the modification of some elements and the addition of other elements.
