آليات تطبيق الصلح الجنائي في مجال جرائم العمل والضمان الاجتماعي.

Résumé: من خلال هذه الورقة البحثية يتم مناقشة تطبيقات الصلح الجنائي في مجال جرائم العمل والضمان الاجتماعي ، لمعرفة موقف المشرع الجزائري من تفعيل الصلح الجنائي في هذا المجال، باعتباره كأحد أهم بدائل الدعوى العمومية ،حيث أن الصلح الجنائي حقق نتائج مهمة في مجال تحقيق مبادئ العدالة الجنائية التصالحية، التي تسعى إلى تفعيل دور الأطراف في الحد من النزاع الجزائي، حيث أثبت الواقع العملي أن الأخذ بسياسة التجريم والعقاب نتج عنه الكثير من العيوب منها التضخم العقابي نتيجة تزايد أعداد القضايا الجنائية عند المحاكم، وطول إجراءات الفصل فيها. Through this research paper, the applications of criminal conciliation in the field of labor crimes and social security are discussed, to know the position of the Algerian legislator regarding the activation of criminal conciliation in this field, as it is one of the most important alternatives to a public lawsuit, as criminal conciliation has achieved important results in achieving the principles of restorative criminal justice , Which seeks to activate the role of the parties in limiting the criminal conflict, as the practical reality has proven that the adaptation of the policy of criminalization and punishment has resulted in many defects, including punitive inflation as a result of the increase in the number of criminal cases in the courts, and the length of adjudication procedures.
