مجلس الأمة: دعامة ديمقراطية أم تعقيد برلماني؟ The Nation Council : A Democratic Pillar Or A Parliamentary Complexity ?

Résumé: ملخص: بالرجوع إلى المذكرة الرئاسية المتعلقة بدستور 1996، برّرت السلطة السياسية آنذاك، الغاية من إنشاء الغرفة الثانية بتدعيم الديمقراطية عن طريق توسيع التمثيل الوطني وضمان التمثيل العادل للجماعات المحلية. إلا أنّ كيفية تكوين هذه الغرفة يبين أنها معضلة دستورية، ونسخة مكررة للغرفة الأولى في الجانب المختص بالتشريع. يؤدي تداخل الاختصاصات في النهاية إلى بطء الوظيفة التشريعية للبرلمان وتعقيدها، وخلق نوع من الرتابة والملل لدى المتتبع لمناقشات عمل تشريعي يعرض على مؤسستين مختلفتين، وفي حالة الاختلاف بينهما تتعقد العملية التشريعية برمتها. كلمات مفتاحية: مجلس الأمة، المجلس الشعبي الوطني، البرلمان، اللجنة المتساوية الأعضاء. abstract : Referring to the Presidential Memorandum on the Constitution of 1996, the political power of that period justifies the objective of creating the second chamber by strengthening democracy, broadening national representation and ensuring equitable representation of local communities. However, the way this chamber was formed shows that this is a constitutional dilemma and a duplicate of the first chamber on the legislative side. The overlap of powers ultimately leads to the slowness and complexity of the legislative function of the Parliament, and creates a sort of monotony and boredom for those who follow the debates on legislative work presented to two different institutions, and in the e vent of differences between them, the legislative process becomes even more complicated.
