آليات استثمار العقار السياحي في التشريع الجزائري

Résumé: تهدف هذه الدراسة إلى تسليط الضوء على الاستثمار في العقار السياحي الذي يُعَد من بين سبل بلوغ النمو الاقتصادي، ولا يتأتى ذلك إلاّ بتوفير العقار محل الاستثمار، وبتأمين ترسانة قانونية فعّالة تساهم في تحقيق الهدف المسطر له قانونا، لذا حدّد المشرع الجزائري مدلول العقار السياحي بتوضيح تشكيله، وطرق تهيئته وحمايته، كما توصلنا إلى إبراز آليات استغلاله في الجزائر باعتباره موردا هاما للاقتصاد، نظرا لتمتع الجزائر القارة بإمكانيات طبيعية متميزة إذا تم استغلالها استغلالاً حكيمًا ستصبح في مصاف الدول الأكثر جَلبًا للسياح والعملة الصعبة، وتبتعد بذلك المنظومة الاقتصادية عن هاجس ارتفاع وانخفاض سعر البترول. This study aims to shed light on Investment in tourism real estate contributes in economic growth, but only by providing real estate, and securing an effective legal framework that realizes the established goals. Algerian legislator define the significance of tourism real estate by clarify its composition, as well as the mechanisms of its exploitation in Algeria as an important resource for the economy. For the reason that Algeria, as a continent with its natural potentials, if it is exploited wisely will become a big country in attracting tourists and hard currency, and its economic system will be far from oil price fluctuations.
