أنظمة الوظيفة العمومية وموقف المشرع الجزائري منها

Résumé: يسود العالم نظامين للوظيفة العمومية، نظام مغلق يتسم بدوام الوظيفة، التي تعتبر حياة مهنية يتفرغ لها الموظف ويكرس لها حياته، ويكون خلالها في وضعية قانونية تنظيمية تجاه الإدارة العمومية، وبوجود قانون أساسي يحكم الوظيفة تتحدد فيه مراكز الموظفين وحقوقهم وواجباتهم، أما النظام الآخر هو النظام المفتوح الذي يتميز بعرضية الوظيفة ( ليست دائمة )، ويكون الموظف في علاقة تعاقدية مع الإدارة العمومية. أما المشرع الجزائري فقد أخذ في مختلف قوانين الوظيفة العمومية المتعاقبة بالنظام المغلق كأصل عام، الذي اعتمدته الدولة أساسا قصد المحافظة على توازن واستمرار الخدمة العمومية، ولكن قصد مواكبة التحولات الاقتصادية والاجتماعية، وبغية إضفاء المرونة اللازمة على عمل الإدارة لكي تتكيف مع محيطها، تم الاستعانة ببعض مظاهر نظام الوظيفة العمومية المفتوح، كاللجوء إلى التعاقد في حالات معينة ومحددة قانونا. Abstract : Prevail in the world two systems of Public Service, the closed system is characterized by permanent job, which is considered a profession or the career professional , and the employee be in the status of legal regulatory toward public administration, The other system is an opened system which is characterized by temporary job, and the employee be in a contractual relationship with the public administration. The Algerian legislator , for objective maintain the balance and the continuation of the public service, has taken in the various laws of the Public Service successive the closed system , but in order to adapt with economic and social changes, and in order to give flexibility to the work of administration , the legislator was used some aspects of the opened system ( the contract in certain cases ) .
