Résumé: يحاول هذا البحث دراسة سياق الموقف ، كونه قرينة غير لغوية استعان بها الأصوليون لفهم النصوص الشرعية خاصة واللغوية بشكل عام، ومنه استثمار الخطاب لاستنباط الأحكام.وهو الأمر الذي يؤكده اللغويون المحدثون في مباحث علم الدلالة ، من ضرورة دراسة النصوص ضمن السياق الذي وردت فيه. This research attempts to study the context of the situation, as it is a non-linguistic presumption that the fundamentalists used to understand the legal texts in particular and linguistic texts in general, and from it the use of discourse to derive judgments.
