تعطيل الدستور في ظل الحالات الاستثنائية

Résumé: الملخص: تتعرض القواعد الدستورية لظروف تجعل من تطبيقها أمرا مستحيلا وتتفاوت هذه الظروف حسب درجة الخطر المهدد لكيان الدولة وأمنها وسلامة ترابها ، وعليه ولمواجهة هذه الظروف الاستثنائية تتخذ من طرف القائمين على السلطة تدابير استثنائية لمواجهة هذه التهديدات مما تنعكس سلبا على القاعدة الدستورية وسموها بتعطيلها تعطيل جزئي أو تعطيل كلي و انتهاك مبدأ الفصل بين السلطات بالتعدي على الاختصاصات الدستورية المقررة لكل سلطة وهذا حسب الحالة التي يتم إعلانها المقرونة طبقا لدرجة الخطر. . Abstract: The constitutional rules are subject to conditions that render their application impossible. These circumstances vary according to the degree of danger threatening the state's entity, security and territorial integrity. Therefore, in response to these exceptional circumstances, the authorities take extraordinary measures to counter these threats, thus negatively affecting the constitutional rule. And the violation of the principle of separation of powers by violating the constitutional competencies prescribed for each authority, and this according to the situation that is announced coupled with the degree of danger.
