المواءمة الدستورية لسنة: 2020 لنشاط المجتمع المدني في الوقاية من الفساد ومكافحته (قراءة في أحكام المادة: 15من قانون الوقاية من الفساد ومكافحته رقم: 06-01 المعدّل والمتمم).

Résumé: تستهدف هذه الورقة البحثية إثارة دسترة نشاط المجتمع المدني في الوقاية من الفساد ومكافحته، الذي أصبح يمارس دورا لا يستهان به في إضفاء الطابع الأخلاقي على الحياة الاقتصادية والمالية والإدارية في الجزائر، باعتبار أن دوره مكمل للدور الحكومي، أين أصبح قوة ضغط فعّالة وشريك لا غنى عنه في تعرية نهب المال العام، وهو ما أسّس له المشرع الجزائري من خلال قانون الوقاية من الفساد ومكافحته المعدل والمتمم، في مادته: 15 مما جعل إشكالية الدراسة تتمحور حول دسترة دور المجتمع المدني في الوقاية من الفساد ومكافحته كدعامة لممارسة دوره الوقائي والإعلامي. إن المراجعة الدستورية لسنة: 2020 في الشق المتعلق بإشراك منظمات المجتمع المدني، قصد الحد من جرائم الفساد ثمّن نشاط هذا الأخير، أين أسّس لضمانات دستورية وعملياتية لممارسة دوره الوقائي والإعلامي في مجابهة الفساد كشريك فعّال لمحاصرة هاته الجريمة، قصد حماية النظام المالي والاقتصادي في الجزائر، وقد توصلنا إلى أن هناك مواءمة دستورية لنشاط المجتمع المدني كضمانة لتعزيز نشاطه الوقائي والإعلامي في مجابهة الفساد. The constitutional review of the year: 2020 in the side of Involving civil society organizations like a Preventive measure to reduce corruption crimes, Activity value of this last one where make a Legal and practical safeguards to practice his Preventive role in anti-Corruption, like a principal partner in Trapping of this crime, to protect the Financial and economic system in Algeria, and we found that there is a Constitutional alignment In the activity of Civil society like a Guarantee to Strengthen of his Preventive role in anti-Corruption.
