مبدأ الشرعية الجنائية بين التراجع وضرورة إعادة النظر

Résumé: يخضع مبدأ الشرعية الجنائية اليوم لحملة تجديد تعتري اغلب أركانه، في بحث عن ثوب جديد يليق بكينونته، بسبب معطيات عدة تلحق السلطة القائمة بالتشريع، وضرورة إقرار هذا الأخير في إطار ما يعرف بمراجعة شكلية انفراد البرلمان بالتجريم والعقاب؛ لما لحقه من قيود على مستوييه الشكلي والموضوعي، وهو التصور الذي يوجب - حتما - إعادة النظر في جودة النص الجنائي، وفعليته لتفادي أزمة تضخم وسائل التجريم، وتشتت أحكام هذا الأخير، وكذا تدارك حالة تراجع القيمة الاجتماعية للقاعدة الجنائية. Summary: The principle of criminal legitimacy is today subject to a renewal campaign, which most of its members feel, in search of a new dress that is appropriate for their own body, because of several data attached to the existing authority and the necessity of approving it within the framework of what is known as a formal review of the parliament's individuals by criminalization and punishment; Because of its limitations on the formal and objective levels, the perception inevitably necessitates a review of the quality of the criminal text, its effect to avoid a crisis of criminalization, the dispersal of the provisions of the latter, as well as the reversal of the social value of the criminal rule.
