درجات بطلان القرار الإداري

Résumé: تعتمد الإدارة في القيام بأنشطتها على القرارات الإدارية باعتبارها الوسيلة المفضلة في تسيير المرافق العامة وتحقيق المصلحة العمومية إلا أنها كثيرا ما تصدر قرارات إدارية غير مشروعة تمس بالمراكز القانونية للإفراد، حيث يلجأ هؤلاء إلى القضاء بغية المطالبة بإلغائها والتعويض عنها إن كان هذا ممكناً، كما أن هذه القرارات تختلف من حيث طبيعة مخالفة الإدارة لمبدأ المشروعية من جهة ومن حيث الآثار التي يرتبها الحكم بالإلغاء، وبالتالي نكون أمام قرارات منعدمة وقرارات باطلة. The administration relies on administrative decisions to carry out its activities, as they are the preferred means for managing public services and achieving the public interest. However, it often issues unlawful administrative decisions that affect individuals' legal positions. In such cases, individuals resort to the judiciary to request their annulment and seek compensation if possible. These decisions vary in terms of the nature of the administration's violation of the principle of legality and the effects resulting from the annulment ruling. Consequently, there are null and void decisions as well as invalid decisions.
