معيار الحرية الأساسية المشمولة بالحماية القضائية المستعجلة

Résumé: تبحث هذه المقالة في تحديد معايير مفهوم الحرية الأساسية التي قصدها التشريع الإجرائي بالحماية القضائية المستعجلة، وقد كشفت الدراسة عن تعدد المعايير الفقهية والقضائية في تفسير المقصود بالحرية الأساسية، والتي يمكن لقاضي الاستعجال الإداري أن يعتمد عليها. وخلصت الدراسة إلى استقرار الممارسة القضائية للقضاء الإداري الفرنسي على مجموعة من المعايير التي يمكن الاعتماد عليها في توصيف الحرية بالأساسية. This article seeks to determine the criteria for the concept of fundamental freedom, which is purposed by the procedural legislation for expeditious judicial protection. The study has revealed the multiplicity of jurisprudential and judicial standards in the interpretation of the basic freedom intent, which the administrative urgency judge can rely on.The study concluded that the judicial practice of the French administrative judiciary is stable on a set of criteria that can be relied upon in describing freedom as fundamental.
