دواعي ومبررات استحداث المحاكم التجارية المتخصصة في التشريع الجزائري .

Résumé: تتميز الحياة التجارية بالسرعة والائتمان سواء في المعاملات بين التجار أو حين تنشأ منازعات بينهم، وهذا ما يقتضي بالضرورة الفصل في هاته المنازعات وفق ما يميز الحياة التجارية؛ ما عزز في توجه المشرع الجزائري لتخصيص قضاء مستقل للفصل في المنازعات التجارية؛ متمثلا في المحاكم التجارية المتخصصة، ومن هذا المنطلق نهدف من خلال دراستنا إلى بيان الاسباب التي دعت المشرع الجزائري لاستحداث محاكم تجارية متخصصة بموجب القانون رقم 22-13 المعدل والمتمم لقانون الاجراءات المدنية والادارية، وكذا عرض تشكيلتها واختصاصاتها وكيفية عملها، باعتبارها آلية قضائية داعمة للتجارة ومعززة للاستثمار؛ مما يساعد في جذب المستثمرين إليها إضافة إلى حفظ الحقوق، كما تعمل على تقليص مدة التقاضي وحل المنازعات التجارية في اسرع وقت ممكن، وبالتالي توفير الوقت لأصحاب القضايا. Business life is characterized by speed and credit, whether in transactions between traders or when disputes arise among them. This necessitates the separation of these disputes according to what distinguishes business life. This led the Algerian legislator to establish specialized courts to adjudicate commercial disputes, represented by specialized commercial courts. Our study aims to clarify the reasons that led the Algerian legislator to establish specialized commercial courts under Law No. 22-13, which amends and supplements the Civil and Administrative Procedure Law. We will also present their composition, jurisdiction, and how they operate, as they serve as a judicial mechanism that supports trade and enhances investment. They contribute to attracting investors and preserving rights while reducing litigation time and resolving commercial disputes as quickly as possible. They also help save time for the parties involved.
