شروط حق الاستعمال الغابي في التشريع الجزائري

Résumé: ملخص إذا كان المشرع الجزائري قد ظم الأملاك الغابية ضمن الأملاك العامة للدولة بنص المادة 12 من قانون الأملاك الوطنية 90/30 كما أخضعت المادة 74 منه النظام القانوني للموارد والثروات الطبيعية وأنماط استغلالها وقواعد تسييرها ومنه الغابات للتشريعات الخاصة التي تطبق على كل منها. فإن قانون الغابات رقم 84/12 والمراسيم المطبقة له هي الأولى بالتطبيق في مجال استعمال واستغلال الغابات. وإذا كانت المادة 34 من قانون الغابات قد نظمت ما يعرف بحق الاستعمال الغابي (حق الانتفاع الغابي في بعض التشريعات الغابية المقارنة) إذ أن حق ملكية الدولة للغابات كملكية عامة مثقل بحقوق الانتفاع لصالح شريحة ما من السكان. فإن ورقتنا هذه تحاول تسليط الضوء على هذا النوع من الاستغلال للأملاك العامة مجسدة في استعمال الأملاك الغابية متعرضة لمضمون هذا الحق وكيف نظم المشرع الجزائري هذا النوع من الاستغلال ؟ ومن هي الفئة المناط بها هذا الحق؟ وما هي طبيعته القانونية ؟ وما هي شروطه وضوابطه؟ وما هو نطاقه؟. Abstract If the Algerian legislature has included forest property among the state’s public property, according to Article 12 of the National Property Law 90/30, Article 74 of it also subjected the legal system of natural resources and wealth, patterns of their exploitation and the rules for their management, including forests, to the special legislation that applies to each of them. Forest Law No. 12/84 and its decrees are the first to be applied in the field of forest use and exploitation. And if Article 34 of the Forestry Law regulated what is known as the right of forest use (the right of forest use in some comparative forestry legislation), since the state's right to own forests as public property is burdened with usufruct rights for the benefit of a certain segment of the population. Our paper tries to shed light on this type of exploitation of public property, embodied in the use of forest property. Exposed to the content of this right, and how the Algerian legislature organized this kind of exploitation? Who is the group entrusted with this right? What is its legal nature? What are its conditions and controls? What is its scope?
