إجراءات التحقيق الخاصة بالأحداث في التشريع الجزائري

Résumé: تعتبر الإجراءات المقررة لمتابعة الحدث من أهم الإجراءات التي تتطلب من المشرع أن يبدي اهتماما كبيرا بفئة الأحداث، فالحدث هو كل طفل لم يبلغ سن الثامنة عشرة كاملة وقت ارتكابه الجريمة، ومن هنا تتحدد مسؤوليته الجنائية، وكثيرا ما يكون الحدث الجانح عرضة لعوامل داخلية وخارجية تدفعه إلى طرق باب الجريمة والوقوع فيها، وقد خصص المشرع الجزائري الأحداث بإجراءات تختلف عن تلك المقررة للبالغين في جميع مراحل الدعوى العمومية، مع مراعاة المراحل العمرية التي يوجد فيها الحدث، وفيما يتعلق بالعقوبات المقررة للأحداث نجد أن طبيعتها الغالبة هي تربوية وتأهيلية، وأخيرا فإن الإجراءات التي اتبعها المشرع في قانون حماية الطفل 12/15، والذي يتعلق بالأحداث، تتوافق إلى حد كبير مع ما أقرته المواثيق والاتفاقيات الدولية بشأن الأحداث، والتي تهدف إلى حماية الحدث الجانح وتأهيله. The procedures established to follow up on the juvenile are considered among the most important procedures that require the legislator to show great interest in the category of juveniles. The juvenile is every child who has not yet reached the full age of eightee at the time of committing the crime, and from here his criminal responsibility is determined. The delinquent juvenile is often vulnerable to internal and external factors that push him To knock on the door of crime and fall into it. The Algerian legislator has designated juveniles with procedures that differ from those prescribed for adults throughout the stages of public prosecution, taking into account the age stages in which the juvenile is present. Regarding the punishments prescribed for juveniles, we find that their predominant nature is educational and rehabilitative. Finally, the procedures followed by the legislator in the Child Protection Law 12/15, which relates to juveniles, are largely in line with what international charters and agreements have approved regarding juveniles, which aim to protect and rehabilitate the delinquent juvenile.
