الإيجار كآلية جديدة لبيع العقارات دراسة مقارنة بين القانون الجزائري والقانون المغربي Rent As A New Mechanism For The Sale Of Real Estate A Comparative Study Between Algerian Law And Moroccan Law

Résumé: ان هذا البحث يهدف إلى دراسة خلاصة ما توصل إليه المشرع الجزائري والمشرع المغربي من قوانين وتنظيمات تتعلق بالإيجار كآلية جديدة لبيع العقارات في كل من التشريعين الجزائري والمغربي، في إطار السعي للتخفيف من أزمة السكن بصفة خاصة، وتحيين المنظومة التشريعية للبلدين ومواكبتهما للتطورات الاقتصادية والاجتماعية الحاصلة بصفة عامة، ورغبة كل منهما في تمكين شريحة عريضة من المواطنين ذوي الدخل المحدود من امتلاك سكن لائق كفيل بضمان العيش الكريم، وهذا عبر إعطاء مفهوم جديد لهذه الآلية التعاقدية غير المألوفة في ضوء النظرية العامة لنظام العقود الذي يقوم على فكرة الإيجار ابتداء وانتهاء بالبيع، ومنه تبيان التمييز الحاصل بين النظام القانوني لإعمال هذه الآلية القانونية التعاقدية بين ما هو مقرر في التشريع الجزائري وبين ما هو مقرر في التشريع المغربي. In this research, we refer to a study that includes the findings of Algerian and Moroccan legislation on rent laws and regulations as a new mechanism for the sale of real estate in both Algerian and Moroccan legislation, in an effort to alleviate the housing crisis in particular, and to revive the legislative system of the two countries and keep up with the economic and social developments taking place in general, and the desire of each of them to enable a segment of the broad population of low-income citizens to own decent housing that will guarantee decent living, by giving a new concept to this unusual contractual mechanism in In light of the general theory of the contract system, which is based on the idea of rent starting with the sale, it shows the distinction between the legal system for the implementation of this contractual legal mechanism between what is decided in Algerian legislation and what is decided in Moroccan legislation.
