فقه الموازنات وأثره في الطب "الفحص الطبي قبل الزواج أنموذجا"

Résumé: ملخص: يهدف هذا البحث إلى دراسة معرفة مفهوم فقه الموازنات من خلال مفهوم العلماء القدامى والمعاصرين له، وشواهد اعتباره من النصوص القرآنية والأحاديث النّبوية الشريفة، وإجماع العلماء، ونتاج العقل، ثم أثر هذا الفقه في المجال الطبي خاصّة ما تعلّق الفحص الطبي قبل الزواج، وما يترتّب عليه من مصالح أو مفاسد، ومن ثمّ إعطاء الحكم الشرعي المناسب بناء على هذه الموازنة التي تحتكم إلى مقاصد الشريعة الإسلامية والقواعد الفقهية وأبواب أصول الفقه المختلفة، ليظهر لنا بعد ذلك حقيقة هذا الفقه وأهميته في حياة النّاس، وإبراز وسماحة ووسطية هذا الدين الحنيف. Abstract: This research aims to study the knowledge of the concept of budgets jurisprudence through the concept of ancient scholars and contemporaries of it, and evidence of its consideration from the Qur’anic texts and prophetic traditions, and the consensus of scholars, and the product of the mind, then the impact of this jurisprudence in the medical field, especially what relates to medical examination before marriage, and what it entails From the interests or spoils, and then giving the appropriate legal ruling based on this budget that governs to the purposes of Islamic law and jurisprudential rules and the chapters of the various principles of jurisprudence, to show us then the reality of this jurisprudence and its importance in the lives of people, and to highlight, tolerance and moderation of this true religion.
