الحقوق العقارية بين الشفعة وحق الاسترداد
Résumé: نظم المشرع الجزائري في القانون المدني وسيلتين قانونيتين تسمحان للشريك في الشيوع استرجاع الحصة التي باعها أحد الشركاء في العقار الشائع إلى أجنبي الشفعة والاسترداد، وهما رخصتان استثنائيتان تقيدان حقوق الغير في التصرف في ماله الخاص رغم أن الشفيع أو المسترد ليس طرفا في عقد البيع ولا يملك حق مراجعته أو نقضه، لكن ولطبيعة الاشتراك جاءت هذه الرخص لحماية الشركاء من أن يرد عليهم أجنبي، والشفعة محددة من حيث الموضوع والإجراءات وترد على العقار والحقوق العقارية الأصلية ، بينما الاسترداد يشمل العقار و المنقول ومجموع المال .
