أحكام الوعد بالبيع العقاري دراسة مقارنة

Résumé: ملخص: يعتبر الوعد بالبيع من أهم الصور الشائعة للعقود التمهيدية، اذ يمثل أسلوبا عمليا مفيدا لتحقيق قدر من الارتباط مستقبلا، عندما لا يكون بمقدور طرفيه ابرام عقد نهائي نظرا لظروف معينة، أو عوامل مادية أو قانونية تحول دون ذلك. فهو عقد تام تتلاقى فيه ارادة الواعد والموعود له تمهيدا لإبرام عقد بيع نهائي، يتضمن في الغالب الاتفاق على جميع المسائل الجوهرية المكونة للعقد الموعود به خلال مدة محددة، كما يستوجب افراغه في الشكل الذي تطلبه القانون تطبيقا لأحكام المادة 71 من القانون المدني الجزائري. يترتب عن انعقاد الوعد بالبيع العقاري صحيحا جملة من الآثار القانونية، تتمثل في نشوء التزام شخصي في ذمة الواعد بالبقاء على وعده طوال مدة الوعد، وفي مقابل ذلك يثبت للموعود له حق شخصي و ليس عيني، يمكنه من اللجوء الى القضاء لاستصدار حكم يقوم مقام العقد النهائي، في حالة نكول الواعد عن وعده، وذلك وفقا لنص المادة 72. الكلمات المفتاحية: وعد بالبيع، عقار، عقد تمهيدي، الشكلية، حق الخيار، حق شخصي، ابداء الرغبة، نكول الواعد. Résumé: La promesse de vente est l’une des formes les plus courantes des avant contrats, car il s’agit d’un moyen pratique et utile afin d’atteindre un engagement dans l’avenir lorsque les parties n’ont plus la possibilité de conclure un contrat définitif à cause de certaines circonstances ou de facteurs physiques ou juridiques. C’est un contrat parfaitement conclu dans lequel la volonté du promettant et du bénéficiaire convergera vers la conclusion d’un contrat de vente définitif, qui comprend souvent un accord sur tous les points essentiels du contrat envisagé dans un délai déterminé, ce dernier doit être conclu selon la forme exigée conformément aux dispositions de l’article 71 du code civil algérien. La promesse de vente immobilière implique une série d'effets juridiques, à savoir l'émergence d'une obligation personnelle auprès du promettant de respecter sa promesse pendant la durée de cet accord, en contrepartie il est permis au bénéficiaire un droit personnel et non réel, lui permettant de recourir à la justice pour rendre un jugement qui vaut contrat final lorsque le promettant se rétracte, et ce conformément à l'article 72. Abstract:         The promise of sale is among the most common forms of pre-contracts since it represents a convenient and useful way to such engagement in the future, when the parties are no longer able to conclude a definitive (final) contract due to certain circumstances or physical or legal factors.           It is a perfectly concluded contract in which the will of the promisor and the beneficiary will converge towards the conclusion of a definitive sale contract, which often includes an agreement on all the essential issues constituting the envisaged contract within a specified period. the latter must also be concluded in the form required according to the provisions of Article 71 of the Algerian Civil Code.          The promise of real estate sales consequents a number of legal effects, represented by the emergence of a personal obligation to the promisor to remain on his promise during the term of this agreement, in return the beneficiary is given a personal right and not real, enabling him to resort to justice to get a judgment that is worth final contract when the promisor retracts, and this in accordance with Article 72 .
