ضمان شفافية ونزاهة الانتخابات على ضوء الأمر رقم 21-01 المتضمن القانون العضوي المتعلق بنظام الانتخابات

Résumé: عملت الجزائر بعد التعديل الدستوري على استرجاع الشرعية للمجالس النيابية، وذلك بحل المجلس الشعبي الوطني، وإصدار قانون ينظم العملية الانتخابية بموجب الأمر رقم 21-01 المتضمن القانون العضوي المتعلق بنظام الانتخابات، يهدف الى أخلقة الحياة السياسية ومكافحة الفساد الانتخابي من خلال إضفاء الشفافية والنزاهة على العملية الانتخابية، بما يضمن منافسة حرة بين المترشحين للفوز بالمقاعد النيابية، ويضمن حرية الاختيار للناخبين بعيدا عن كل تأثير مادي، بُغْيَةَ استرجاع ثقة الهيئة الناخبة، للمشاركة في الحياة السياسية، فتم إبعاد السلطة التنفيذية عن تنظيم وتسيير العمليات الانتخابية وإسنادها إلى سلطة مستقلة، مع منع الأشخاص الذين لهم صلة بالمال الفاسد من الترشح. Abstract: After the constitutional amendment, Algeria worked to restore the legitimacy of the parliamentary councils, by dissolving the People’s National Assembly, and issuing a law regulating the electoral process under Ordinance No. 21-01 containing the organic law related to the electoral system, aiming to moralize political life and combat electoral corruption by imparting transparency and integrity to the process. In order to guarantee free competition between candidates to win parliamentary seats, and to guarantee freedom of choice for voters away from all material influence, in order to restore the confidence of the electorate, to participate in political life, the executive authority was removed from organizing and supervising electoral processes and assigning them to an independent authority, while preventing Persons connected with corrupt money from running.
