دراسة السلطة الوطنية المستقلة للانتخابات على ضوء دستور 2020

Résumé: السلطة الوطنية المستقلة للانتخابات مؤسسة أستحدثها المشرع الجزائري بموجب القانون العضوي 19-07، بهدف ضمان شفافية ونزاهة العملية الانتخابية، ثم أدرجها المؤسس الدستوري في التعديل الدستوري لسنة 2020. تعتبر المؤسسة الوحيدة المخولة قانونا وحصريا الإشراف الكامل على جميع مراحل العملية الانتخابية بداية من التحضير والتنظيم إلى الإعلان عن النتائج. لأداء مهامها بكل حرية حياد ومن دون تحيز، خصها المشرع بجملة من الضمانات بموجب القانون العضوي المتعلق بنظام الانتخابات 21-01، تخولها القدرة على أداء مهامها قبل وأثناء وبعد العملية الانتخابية. Abstract: The Independent National Authority for Elections is an institution created by the Algerian legislator under Organic Law 19-07, with the aim of ensuring the transparency and integrity of the electoral process, then inscribed by the constitutional founder in the constitutional amendment of 2020. It is the only institution authorized by law and exclusively to fully supervise all stages of the electoral process, from preparation and organization to the announcement of the results. In order to exercise his functions with complete freedom, impartiality and without prejudice, the legislator has attributed to him a set of guarantees under the organic law relating to the electoral system 21-01, which confers on him the right to be able to exercise his missions before, during and after the electoral process.
