خصوصية قواعد التحكيم في قطاع البريد والاتصالات الإلكترونية في الجزائر

Résumé: ملخص: يعد نظام التحكيم من أهم الوسائل الحديثة البديلة لحل النزاعات والمفضلة لدى المستثمرين خاصة الأجانب منهم عن التوجه للقضاء، لكن على خلاف ذلك نجد في بعض القطاعات الحساسة قد فرض المشرع نظام التحكيم الداخلي الإجباري كما هو معمول به في قطاع البريد والاتصالات الإلكترونية أمام سلطة الضبط، والتي أثبتت قدراتها في حل النزاعات الناشئة بين المتعاملين فيما بينهم، والمتعاملين والمستعملين في النزاعات المتعلقة بالتوصيل البيني، النفاذ، التجوال الوطني وتقاسم المنشآت. بينما فرض إجراءات التحكيم عليهم يعتبر تقييدا لحريتهم في اختيار الجهة التي تقوم بفض النزاعات القائمة، فالطعن في قرارات التحكيم الصادرة عن سلطة الضبط أمام مجلس الدولة لا يوقف التنفيذ، ويصعب مهمة دراستها لا من الناحية الزمنية ولا النصوص التشريعية المطبقة عليها والرجوع للقواعد العامة. Abstract: The arbitration system is one of the most important modern alternative means of resolving disputes and the preference of investors, especially foreigners, to go to justice, but in some sensitive sectors, the legislature has imposed the compulsory internal arbitration system as applied in the postal and electronic communications sector before the regulation authority It has demonstrated its ability to resolve disputes between clients, operators and users in interconnection, interoperability, roaming, and facility sharing disputes. While imposing arbitration procedures on them is a restriction on their freedom to choose the party that disputes existing, challenging arbitration decisions issued by the control authority before the State Council does not stop execution, and the task of studying them is difficult for time, for legislative provisions applied to them, and for reference to general rules.
