ملامح التجديد في المنهج الفقهي عند شهاب الدين القرافي

Résumé: ملخص: يُعد الإمام القرافي أحد العلماء الأوائل الذين انتبهوا إلى مظاهر الخلل والقصور التي أصابت الفقه الإسلامي في طريقة عرضه والتأليف فيه ، بسبب انتشار التقليد ، واتجاه أغلب المؤلفات الفقهية إلى الاختصار وشرح المختصر ، مع التعقيد في الصياغة ، وعدم العناية الكبيرة بجانب الترتيب ونظام التهذيب في تناول المسائل الفقهية ، أدى ذلك إلى ضعف حيوية الفقه ، وذهاب رونقه وجماله ، وانصراف الطلاب عنه ، فاتجهت جهود بعض العلماء ومنهم القرافي إلى تقديم منهج أصيل وبديع في عرض الفقه والتصنيف فيه. Abstract: Imam al-Qarafi is one of the first scholars who are aware of the flaws and shortcomings that have affected the Islamic jurisprudence in the way it is presented and composed, because of the spread of tradition and the tendency of most jurisprudence to shorten and explain the abbreviated, complicated drafting, Jurisprudence, this led to the weakness of the vitality of jurisprudence, and the departure of elegance and beauty, and the departure of students from him, addressed the efforts of some scholars, including the Qarafi to provide an authentic and beautiful approach in the presentation of jurisprudence and classification.
