Résumé: الملخص يتناول هذا المقال القاعدة الفقهية المذكورة في العنوان، والتي أوردها السيوطي في كتابه "الأشباه والنظائر"، بالتحليل والنقد، انطلاقا من إشكال ما يمكن أن يترتب عليها من آثار في السلوك وما يشعِر به مضمونها من تناقض بينه وبين نفي الحرج وإرادة التخفيف والتيسير في الشريعة، ثم بيان مصدرها وتوثيقها وما تستند إليه من أدلة نقلية وعقلية وقرائن الأحوال، ثم مناقشة هذه الأدلة والاستدلال على أن الفضل والأجر في الأعمال بقدر ما تجلبه من منفعة أو تدفعه من مفسدة. وأخيرا انتهى المقال إلى نتيجة ما يجب أن يكون عليه موقف وسلوك المكلف قبل وبعد الدخول في الأعمال الشاقة.
