ضوابط صياغة التشريع الفرعي وأثره على تحقيق الأمن القانوني في الجزائر Controls For Drafting Subsidiary Legislation And Its Impact On Achieving Legal Security In Algeria

Résumé: تعد العملية التشريعية وسيلة الدولة في فرض هيمنتها وسلطتها، وآلية لتحقيق سيادة القانون وتجسيد وظائفها، وحفاظا على توازن السلطات أوكل المشرع الدستوري مهمة سن التشريع للسلطة التشريعية كاختصاص أصيل، مع مشاركة السلطة التنفيذية في صناعة القانون الذي يعرف بالتشريع الفرعي كاختصاص استثنائي. غير أن التدخل المفرط للسلطة التنفيذية في وضع اللوائح أصبح ينافس ويكاد يحتكر العمل التشريعي، مما قد يؤدي إلى المساس بمبدأ الأمن القانوني وزعزعة استقرار المراكـز القانونية للمخاطبين بنصوصه. وعلى هذا الأساس فإن هذه الدراسة تهدف إلى معرفة أساس الدور التشريعي للهيئة التنفيذية من خلال الإحاطة بضوابطه وبالمشاكل والجزئيات التي تفرزها الممارسة العملية للقانون التنفيذي، ومدى تدخل الدستور في محاولة إعادة التوازن بين السلطتين التشريعية والتنفيذية إعمالا لمبدأ الفصل بين السلطات، وتأثير تذبذب صياغة التشريع الفرعي على نفاذ القانون. وقد خُلصت الدراسة إلى جملة من النتائج، كان أبرزها ضرورة مراعاة الهيئة التنفيذية للنظام الهرمي القانوني لمطابقة الدستور في إصدار التنظيمات، وعدم سن أي نصوص من شأنها المساس بالحقوق والحريات، مع توفير آليات الحماية القانونية اللازمة، لضمان فصل حقيقي بين السلطة التشريعية والتنفيذية دون الإخلال بالعلاقة الوطيدة بين النص التشريعي والتنظيمي، وهذا تحقيقا لسيادة القانون وهيمنته. : Abstract The legislative process is the state’s means of imposing its hegemony and authority, and a mechanism for achieving the rule of law and embodying its functions. In order to preserve the balance of powers, the constitutional legislator entrusted the task of enacting legislation to the legislative authority as an inherent jurisdiction, with the participation of the executive authority in making the law , which is known as subsidiary legislation as an exceptional jurisdiction. However, the excessive interference of the executive authority in setting regulations has begun to compete with and almost monopolize legislative work, which may lead to compromising the principle of legal security and destabilizing the legal positions of those addressed by its texts. On this basis, this study aims to know the basis of the legislative role of the executive body through being aware of its controls and the problems and details that emerge from the practical practice of executive law, and the extent of the intervention of the Constitution in an attempt to restore the balance between the legislative and executive powers in implementation of the principle of separation of powers, and the impact of fluctuations in the formulation of subsidiary legislation on Law enforcement. The study concluded with a number of results, the most prominent of which was the need for the executive body to take into account the legal hierarchical system to comply with the constitution in issuing regulations, and not to enact any texts that would affect rights and freedoms, while providing the necessary legal protection mechanisms, to ensure a real separation between the legislative and executive power without disturbing the relationship. The close relationship between the legislative and regulatory text, and this is to achieve the rule of law and its dominance.
