الحماية الجزائية لسجلات المعاملات التجارية الإلكترونية Criminal Protection Of Electronic Business Transaction Records

Résumé: لممارسة المورد الإلكتروني نشاطه التجاري عبر شبكة الانترنت يحتاج لعدة وسائل من بينها سجلات يقوم من خلالها تقييد كامل المعاملات التجارية الإلكترونية لما في ذلك عدة مزايا تعود على المورد الإلكتروني وعلاقته بكل من الجهات المنظمة لنشاط التجارة الإلكترونية والمستهلك الإلكتروني، إلا أن هذه السجلات تحتاج لحماية قانونية جزائية تصب في صالح كل من المستهلك الإلكتروني بحيث تجنبه الضرر الذي قد يتعرض له جراء المساس ببياناته الشخصية المعالجة آليا من أجل إبرام المعاملة الإلكترونية، ولصالح المورد الإلكتروني إذ تساهم في بعث الثقة في نفوس عملائه وبالتالي تزدهر معها نشاطاته التجارية على المنصة الإلكترونية. To practice the electronic supplier's business through the Internet needs several means, including records through which to restrict the entire electronic business transactions, including several advantages for the electronic supplier and its relationship to both the regulators of the e-commerce activity and the electronic consumer, but these records need a criminal legal protection that benefits both the electronic consumer so as to avoid the harm that may be suffered by the infringement of his personal data processed automatically in order to conclude the electronic transaction, and in the interest of the electronic supplier as it contributes to inspire confidence in its customers and thus flourish with it its business activities on the online platform.
