الآليات التكنولوجية الحديثة في النقل البحري خدمةً للبيئة:تحدياتٌ قانونية Modern Technological Mechanisms In Shipping For The Environment: Legal Challenges

Résumé: أصبحت التطورات في مجال الذكاء الاصطناعي و الأتمتة، ذات صلة بالنقل البحري بشكل كبير و متزايد لما توفره من زيادة في السلامة و المحافظة على البيئة البحرية نتيجة الحد من الحوادث.فكان التطور التكنولوجي الحل الرئيسي لدفع الصناعة البحرية نحو مستقبل خال من الكربون من خلال تقنيات جديدة في النقل البحري المراعي للبيئة والمستدام. نتيجة لذلك ، أنشأت التكنولوجيا أوضاعا جديدة، جعلت دورها يتجاوز إشباع الرغبات الاستهلاكية إلى دور وظيفي من خلال حل المشاكل ، من بينها المشاكل البيئية. هذا ما قد يؤدي إلى غموض و إشكالات، ويفرز تحديات نتيجة فجوة بين القانون الذي يتطلب فاصلا زمنيا لاستقرار المراكز القانونية و سرعة التطور التكنولوجي . مما يفرض مواجهته بإرساء منظومة قانونية وفق أسس مرنة و قائمة على التكييف الضمني للنظم القانونية الحالية للملاحة البحرية حتى يتمكن التشغيل الذاتي لوسيلة النقل من أن يحقق بيئة بحرية آمنة. Abstract: Developments in the field of artificial intelligence and automation have become significantly and increasingly relevant to maritime transport because of its increased safety and preservation of the marine environment as a result of accident reduction. Technological development was the key to driving the marine industry towards a carbon-neutral future through new technologies in green and sustainable shipping. As a result, technology has created new situations, making its role beyond satisfying consumer desires to a functional role by solving problems, including environmental problems. This may lead to ambiguity and problems, and create challenges, as a result of a gap between the law requiring a time lapse for the stability of legal centres and the speed of technological development. This requires confronting it by establishing a legal system based on flexible and tacit adaptation of existing maritime legal systems so that the autonomous operation of the means of transport can achieve a safe marine environment
