Résumé: إن جرائم المضاربة غير المشروعة والممارسات التجارية الاحتكارية تؤثران سلبا على نظام السوق واستقراره وعلى حقوق المستهلك والاقتصاد الوطني، لذا كان لزاما على المشرع الجزائري التدخل بتكريس آليات قانونية وأخرى مؤسساتية من أجل تجريم صور هذه الممارسات التجارية غير المشروعة، وهو ما تجسد فعلا بإقرار عقوبات جزائية صارمة وأخرى إدارية تكميلية على مرتكبي تلك الجرائم وذلك من أجل ردعها والحد منها. The illegal speculation crimes and monopolistic commercial practices negatively affect to the market system and its stability, and on consumer rights and the national economy. Therefore, it was necessary for the Algerian legislator to intervene by consecrating legal and other institutional mechanisms to criminalize the forms of these illegal commercial practices, which was actually functional by adopting of strict criminal penalties and complementary administrative measures for the offenders of these crimes, this is in order to deter and limit them.
