The Legal Element Of Environmental Crime Between The Inevitability Of Submitting To The Principle Of Legality And The Necessity Of Protecting The Environment

Résumé: تهدف هذه الدراسة إلى إبراز خصوصية الركن الشرعي للجريمة البيئية، والذي يختلف عن الجرائم التقليدية سواء من حيث طبيعة الجريمة البيئية أو طبيعة النص التجريمي البيئي في حد ذاته، أو من حيث الجزاء المقرر للسلوك المخالف، هذا مادفع المشرع إلى اتباع أساليب تشريعية خاصة بهدف حماية البيئة والتي تتمثل في كل من أسلوب التشريع على بياض، التفويض التشريعي، الإحالة، التفسير الكاشف، وهذا ما جعل البعض يعتقد أن في ذلك خروجا على مبدأ الشرعية الجزائية. This study aims to highlight the specificity of the legal element of environmental crime, which differs from traditional crimes, whether in terms of the nature of the environmental crime or the nature of the environmental criminal text itself, or in terms of the penalty prescribed for violating behavior. This is what prompted the legislator to follow legislative methods with the aim of protecting the environment. Which is represented by the method of blank legislation, legislative authorization, referral, and revealing interpretation, and this is what made some believe that this is a departure from the principle of criminal legitimacy
