عقد الإيجار في القانون التجاري الجزائري

Résumé: ظهر القانون التجاري وتكور مع التطورات التي شهدها العالم خاصة في المجال الاقتصادي وهذا جعل الدولة الجزائرية في حاجة ملحة لتعديل قانونها ليتماشى مع التطور الاقتصادي بعد الانفتاح على اقتصاد السوق، ومن أهم العقود التي نظمها هذا القانون هو عقد الإيجار التجاري والذي شهد مرحلتين من خلال التعديل الذي لحق بالقانون التجاري وأدى هذا التعديل لتغيير إجراءات وقواعد في الإيجارات لتتماشى مع ما يحصل في العالم؛ وباعتبار أن التعديلات التي مست عقد الإيجار التجاري في العديد الجوانب والتي غيرت مجرى الحماية القانونية الممنوحة للمؤجر أو المستأجر، فكان لابد من إلقاء الضوء على هذه التغييرات ومدى تأثيرها أو انعكاسها على الحياة التجارية. The commercial law appeared and rolled with the developments in the world, especially in the economic field, and this made the Algerian state in urgent need to amend its law in line with economic development after opening up to the market economy, and one of the most important contracts organized by this law is the commercial lease contract, which witnessed two phases through the amendment that He was attached to the commercial law, and this amendment led to a change in procedures and rules in rentals to be consistent with what is happening in the world Considering that the amendments that affected the commercial lease contract in many aspects, which changed the course of legal protection granted to the lessor or the lessee, it was necessary to shed light on these changes and the extent of their impact or reflection on commercial life.
