أحكام مكافحة جريمة تبييض الأموال في التشريع الجزائري

Résumé: ملخص: اتفقت معظم التشريعات الحديثة على خطورة جرائم تبييض الأموال بما فيها التشريع الجزائري, وإن اختلفت بخصوص الأساليب التي تتم بها هذه الجرائم وذلك بسبب اختلاف التشريعات والأنظمة المصرفية من دولة لأخرى من جهة, ونظراً للإمكانيات المتاحة لمبيضي الأموال من جهة أخرى. هذا الأمر أدى إلى ضرورة إيلاء عناية خاصة من قبل المشرع الجزائري بغية التكفل الفعال بهذه الظاهرة الإجرامية الحديثة, فعمد إلى فرض ضوابط صارمة من شأنها التخفيف من حدة الظاهرة. وبالرغم من الإجراءات والآليات المتخذة والمنصوص عليها في قانون الوقاية من تبييض الأموال وتمويل الإرهاب ومكافحتهما, إلا أن العديد من العوائق تقف حائلاً دون المكافحة الفعالة لهذه الجريمة على غرار مبدأ السرية المصرفية والذي يقف عائقاً في غالب الأحيان دون الإفصاح عن المعاملات المالية ذات الصلة بجرائم تبييض الأموال. Provisions of combating the crime of money laundering in the Algerian law Abstract : Most modern laws agreed on the seriousness of money laundering, including Algerian law crimes, despite the differences in regard to the methods which these crimes because of the different legislation and banking regulations from country to country on the one hand, because of the possibilities available to money launderers on the other. This led to the need to pay special attention by the Algerian law in order to effectively these modern provide for criminal phenomenon, have resorted to the imposition of strict controls that will mitigate the phenomenon. Although the procedures and mechanisms taken and set forth in the prevention of money laundering and terrorist financing and control law, however, many obstacles stand in the way without effective control of this crime along the lines of the principle of banking secrecy, which is an obstacle, often without disclosing the related money laundering crimes of financial transactions .
