Résumé: الملخص: تحتل براءة الاختراع مركزا هاما في الحياة الاقتصادية خاصة في البلدان المتقدمة، وذلك نظرا للآثار الناجمة عن استغلالها؛ وعلى هذا الأساس اعتبر أن أهم قوانين الملكية الصناعية هو قانون براءة الاختراع لما يترتب عليه من آثار قانونية واجتماعية. الأمر الذي حتم على المشرع الجزائري تبني نظام حمائي لبراءة الاختراع من كل اعتداء، و هذا ما نهدف إلى دراسته في هذا الموضوع بحيث سنسلط الضوء على الحماية المدنية لبراءة الاختراع في التشريع الجزائري ومدى فاعليتها. Abstract : The patent occupies an important position in economic life, especially in developed countries, due to the effects resulting from its exploitation. On this basis, he considered that the most important industrial property law is the patent law, due to its legal and social effects. Which made it imperative for the Algerian legislator to adopt a patent protection system from every attack, and this is what we aim to study in this topic so that we will shed light on the civil protection of the patent in the Algerian legislation and its effectiveness.
