نطاق الحماية القضائية لبراءة الاختراع

Résumé: لقد أقر المشرع الجزائري حق لصاحب براءة الاختراع في استغلالها والتصرف فيها،إلا أنه قد يحدث وأن يقع اعتداء على اختراع محمي بالبراءة، وهنا وجب حماية هذه البراءة، حماية جزائية إذا ما توفرت أركان الجريمة، كما يمكن حمايتها حماية مدنية، إلا أن هذه الحماية ليست مطلقة فهي حماية محدودة من جهة لكونها إقليمية، كما أن الاختراعات السرية ومنح الرخص الإجبارية تحد من حقوق صاحب البراءة، إضافة إلى كونها حماية مؤقتة تنقضي بسبب انتهاء المدة أو التخلي عن الحقوق أو بسبب بطلان البراءة أو سقوطها. The Algerian legislator has recognized the right of the patent owner to exploit and dispose of it, but it may happen and that an invention protected by the patent may be attacked. Absolute protection is limited on the one hand because it is territorial, and secret inventions and the granting of compulsory licenses limit the rights of the patent holder, in addition to being a temporary protection that may lapse due to the expiration of the term or the abandonment of rights or due to the invalidity or forfeiture of the patent.
