أحكام الوعد بالبيع العقاري في القانون الجزائري

Résumé: يعتبر الوعد بالبيع العقاري تصرفا قانونيا فيو عقد تام شكمي مستقل بذاتو ويخضع لعدة شروط مثمو مثل العقود األخرى ويمجأ إليو المتعاقد في حالة وجود ظروف طبيعية أو قانونية تعيق عقد البيع النيائي ، وىذا ما يميز ىذا النوع من التعاقد عن غيره من العقود وىو ضرورة الشير العقاري. حيث سن لو المشرع الجزائري مجموعة من األحكام الخاصة تنتج عنو آثار قانونية وىذا ما نصت عميو المادة 71 72- من القانون المدني الجزائري حيث يعتبر عقد تام بمعنى الكممة وينعقد مثمو مثل العقد النيائي فال ينعقد إال بتوفر شروطو وأركانو المتطمبة قانونيا، وتنجر عميو جممة من اآلثار القانونية تتمثل في نشوء التزام شخصي في ذمة الواعد طوال مدة العقد بالبيع في حين أن لمموعود لو الحق الشخصي يمكنو المجوء إلى القضاء . الكممات المفتاحية :الوعد بالبيع العقاري ،اآلثار القانونية ، انعقاد الوعد، الحق الشخصي ، العقد النيائي Abstract The promise of real estate sale is a legal act, as it is a complete contract that is independent and is subject to several conditions, like other contracts, and the contractor resorts to it in the event of natural or legal circumstances that hinder the final sale contract, and this is what distinguishes this type of contract from other contracts, which is the necessity of real estate registration.
