تخصيص عام النص بالغاية وأثره في استنباط الأحكام الشرعية: دراسة نظرية تطبيقية

Résumé: الملخّص من المقرر عند الأصوليين تخصيص العام بما يتصل به . وهو أقسام : شرط ، صفة ، استثناء ، وغاية . ومن هذا المنطلق يسعى هذا البحث إلى استكشاف حقيقة عام النّص بالغاية ، وإبراز أثره في استنباط الأحكام الشّرعية ؛ مسترشدين بآراء الفقهاء والأصوليين في تحديد الخلاف في مسألة جواز التّخصيص بالغاية في ضوء تطبيقات فقهية على آيات قرآنيّة ونبوية منتقاة . وللوقوف على جوهر هذا الخلاف تطلّب البحث استجلاء آراء النحاة في أدوات الغاية باعتبارها وسيلة لتحقيق الغاية . Summary It is scheduled for fundamentalists to allocate the year in relation to it. It is sections: condition, attribute, exception, and purpose. In this sense, this research seeks to explore the general truth of the text and to highlight its effect in the development of the Shari'a rulings, guided by the opinions of the jurists and fundamentalists in determining the difference in the issue of permissible appropriation in the light of doctrinal applications on selected Qur'anic and prophetic verses. In order to determine the essence of this dispute, the research sought to elucidate the views of the women in the tools of the end as a means to achieve the end.
