مســلك الإيمـــاء وأثــره في استنبــاط الأحكــام

Résumé: الملخص استهدف هذا البحث دراسة " مسلك الإيماء وأثره في استنباط الأحكام الشرعية " بصورة تأصيلية تطبيقية، توضح من خلالها حيثيات الموضوع من حيث تعريفه، وحجيته، وأنواعه، وبيان أهميته كطريق من طرق استنباط العلة، وبيان أثره على الفروع الفقهية خاصة في باب العبادات، والمعاملات، وأثره في ترجيح الأحكام الفقهية، وأوضحت الدراسة أن هذا المسلك يعد مهما في الكشف عن علل الأحكام، والمعاني، وله أنواع متعددة يمكن ضبطها بأن ما تحقق فيه اقتران بين حكم، ووصف بحيث لو لم يكن ذلك الوصف علة في ذلك الحكم لكان الاقتران مستبعدا، وإمكانية ذلك بالتخريج على المستجدات، ونوازل العصر الحديث. ABSTRACT This research aimed to study the "way of gesturing and its impact on deriving legal rulings" in an applied and original manner Through which it clarifies the merits of the subject in terms of its definition, authoritativeness and types, and demonstrates its importance as one of the methods. Deduction of the cause, and an explanation of its impact on the branches of jurisprudence, especially in the chapter on worship and transactions, and its impact on the most correct jurisprudential rulings, and the study showed that this course is important in revealing the cause of rulings and meanings, and it has multiple types that can be controlled by the fact that what was achieved in it is a coupling between a ruling and a description so that if that description was not a fault in that ruling, the association would have been excluded, and the possibility of that by avoiding the recent issues and contemporary fiqh of modern day.
