Résumé: The policy of development and encouragement of investment in Algeria requires a complete state organization, that organizes the investment on the one hand, and on the other hand organizes the exploitation of the land which essentially controls the application of this policy, including the exploitation of industrial land, this is done by the concession contract which is one of the legal mechanisms chosen by the state to exploit the lands under its private domain, in the framework of the realization of the investment projects and ensured the success of this policy through the ordinance 08/04 dated 01/09/2008 fixing the conditions and methods of concession of the lands falling in the private domain of the state intended for the realization of investment projects, with the accompanying executive decrees, example the executive decree 09/152 dated 02/05/2009 fixing the terms and conditions of concession of the lands belonging to the private domain of the State intended for the realization of investment projects and Executive decree 09/153 dated 02/05/2009 setting the terms and conditions for the concession and management of the residual assets of dissolved and non-autonomous SOES and surplus assets of public economic enterprises.
