أحكام بيع السّلَم في مذهب الإمام مالك وأوجه الاستفادة من انفرادات المذهب في السّلَم المعاصر

Résumé: يعالج هذا البحث مسائل مهمّات في عقد بيع السَّلَم في مذهب الإمام مالك بن أنس، مع العناية ببحث المسائل التي انفرد بها، وطرق الاستفادة منها لتطوير أداء المصارف الإسلامية، بمنهج تحليلي للمسائل، واستقرائي للنصوص والأقوال ، انطلاقا من بيان ماهية بيع السلم ومشروعيته، ثم بيان شروطه في مذهب الإمام مالك، وعرض أوجه الاستفادة من انفرادات مذهب الإمام مالك في السَّلَم المعاصر. This research deals important issues in the contract of Salm's sale in the view of Imam Malik ibn Anas, with examining issues that he was characterized by them, and ways to use them for the development of Islamic banks performance, using an analytical approach for issues, and inductive texts and statements, where we show the concept of " salm's " sale and its legitimacy, and show conditions in the doctrine of Imam Malik, and studding the aspects of benefit from issues that the doctrine of Imam malik was characterized by them in contemporary " Salm ".
