الأليات القانونية لأستغلال العقار الفلاحي الخاص في الجزائر

Résumé: إن الأراضي الفلاحية تشكل ثروة اقتصادية هامة، بالرغم من ضمان حق الملكية الخاصة دستوريا إلا أنه لا يعني أن صاحب الأرض الفلاحية حر في استغلال أو عدم استغلال ارضه بل الزم المشرع الجزائري كل من مالك العقار الفلاحي استغلاله استغلال مباشر أو غير مباشر، وإلا اعتبر متعسفا في استعمال الحق. كما أن القانون العقاري جاء بمفاهيم جديدة وأعاد الاعتبار للملكية العقارية الخاصة لاسيما الملكية الفلاحية، كما اهتم المشرع بالأراضي الفلاحية لما تلعبه من دور في تحقيق الأمن الغذائي، فاحتفظ للدولة بسلطة الرقابة على هذه الأراضي وذلك بإنشاء آليات قانونية لحمايتها وحسن استغلالها، فتمثلت في إنشاء جهازين إداريين هما لجنة إثبات عدم استغلال الأراضي الفلاحية والديوان الوطني للأراضي الفلاحية، كما رتب جزاءات عن عدم استغلال الأراضي الفلاحية قد تصل إلى حد بيع الأراضي الفلاحية. Abstract: The agricultural lands constituted an important economic revolution, although the of private ownership was constitutionally guaranteed, but it means that the owner of the agricultural land is free to exploit or not exploit a land. Rather, the legislator obliged of the each of the owner of agricultural property to exploit it directly or indirectly, otherwise it is considered abusive in the exploitation of the right. In addition , the real estate law introduced new concepts and restored the consideration of private estate, especially agricultural property, and the legislator also cared about agricultural lands because of the role they play in achieving food security, so the state preserved the authority to control these lands by establishing legal mechanisms to protect and exploit them, represented by two administrative bodies.
