الإطار القانوني للجريمة البيئية في التشريع الجزائري The Legal Framework Of Environmental Offense In Algerian Legislation

Résumé: يتميز الإطار القانوني للحماية الجزائية للبيئة في التشريع الجزائري بتناثر احكامه على العديد من النصوص القانونية ذات الصلة بالبيئة، ما يجعل موضوع حصرها والرجوع إليها أمر صعب، خاصة في ظل تداخل بعض المواد ببعضها. لا يمكن تحقيق الأهداف المتوخاة من هذا الإطار القانوني، خاصة في بعده الجزائي، لاعتبارات مردها؛ من جهة؛ النظرة العادية التي يعتمدها المشرع إزاء الجرائم البيئية. ومن جهة أخرى، انتهاج المشرع لسياسة تجريميه ذات طابع تقليدي مناطها تغليب الطابع الردعي اللاحق على ارتكاب الجريمة البيئية على حساب الجانب الوقائي. The legal framework of the protection of the environment in Algeria is characterized by the dispersion of its rules over several legal texts in relation to the environment, hence the difficulty of identifying and delimiting it, especially in the context of the entanglement of these articles. The legal framework for the protection of the environment in general, and in its penal dimension in particular, cannot achieve these objectives for at least two reasons: on one hand, it is because of the minimalist vision that Algerian environmental legislation towards environmental offenses, and on the other hand it is because of the primacy of the objective of repression over that of prevention which characterizes Algerian environmental penal policy.
