آليات مكافحة المضاربة غير المشروعة في ظل القانون 21/15

Résumé: الملخص: بالرغم من التوجه الاقتصادي للمشرع الجزائري إلى اقتصاد السوق، إلا أنه أخضع السلع والبضائع لمراقبة أسعارها بأن جعلها تخضع للتقلبات الطبيعية للعرض والطلب في السوق ولحرية المنافسة ،لأن عملية مراقبة الأسعار من أهم ركائز التنمية والإصلاح الاقتصادي، حيث لا ينحصر نشاط الدولة في توفير السلع ،الخدمات العمومية وحماية الملكية الخاصة،و إنما يتعداه إلى نماذج قائمة على التدخل الاقتصادي حيث تلعب الحكومة دورًا نشطًا في تصحيح تقلبات السوق ودعم الرعاية الاجتماعية، فتعمل على تفادي و تجريم الأعمال التي من شأنها أن تؤدي إلى عدم استقرار الأسعار واضطراب السوق، ومما لا شك فيه أن الظروف التي شهدتها الجزائر في الآونة الأخيرة من مضاربة في المواد الواسعة الإستهلاك للمواطن خلال فترة تفشي وباء كورونا، دفعت بالمشرع الجزائري إلى سن القانون (21/15) المتعلق بالمضاربة غير المشروعة ناصا على مجموعة من الآليات القانونية لمكافحة هذه الجريمة . Abstract : Despite the economic orientation of the Algerian legislator towards the market economy, he subjected goods and commodities to the control of their prices by subjecting them to the natural fluctuations of supply and demand on the market and to free competition, because the process of price control is one of the most important pillars of development and economic reform, where the activity of the state is not limited to the provision of goods, services It goes beyond models based on economic intervention, where the government plays an active role in correcting market fluctuations and supporting social welfare It strives to avoid and criminalize actions that would lead to price instability and to market turbulence. The circumstances that Algeria has witnessed recently in terms of speculation on consumer goods of the citizen during the period of the Corona epidemic, prompted the Algerian legislator to promulgate the law (21/15) relating to illicit speculation , stipulating a set of legal mechanisms to combat this crime.
