جهود وثورات لدسترة الحقوق والحريات

Résumé: يهدف هذا المقال إلى دراسة جهود فقهاء نظرية العقد الاجتماعي في محاربة الظلم واضطهاد الشعوب من قبل الحكومات المطلقة، وتأسيس السلطة على العقد الاجتماعي الذي يضمن الحقوق والحريات وتقييد السلطة. كما يسعى إلى بيان تأثير العقد الاجتماعي في الثورات الثلاثة: الإنجليزية والأمريكية والفرنسية ودور هذه الثورات في دسترة حقوق الإنسان وإقامة دول عصرية قوية مبنية على قواعد المساواة والحرية والشفافية والمسؤولية والتداول على السلطة. Abstract: This article aims to examine the efforts of the scholars of the social contract theory in the fight against injustice and oppression of peoples by governments absolute authority, and the establishment of authority on the social contract, which guarantees rights and freedoms and restrict the power. It seeks to describe the impact of the social contract in the three revolutions: The English, the American and the French, and the role of these revolutions in the constitutionalization of human rights and establishment of strong modern states based on equality, freedom and transparency, responsibility and alternating of power.
